3. Definitions
3.1 A consumer, pursuant to § 13 of the German Civil Code (BGB), is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed in nature.
3.2 A business, pursuant to § 14 BGB, is any natural or legal person or partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or self-employed professional activity.
4. Conclusion of Contract
4.1 The presentation of goods in the online shop does not constitute an offer by Interior Couture GmbH to conclude a purchase contract, but merely an invitation to the customer to submit a legally binding order. The binding order by the customer is placed by clicking the "Buy" button at the end of the ordering process.
4.2 Following this, the customer will promptly receive confirmation of the order received via an automatically generated email to the email address provided by the customer during the ordering process. This email does not yet constitute the conclusion of a purchase contract. It merely confirms receipt of the order by Interior Couture GmbH.
4.3 The purchase contract is concluded upon receipt of a further email designated as an "Order Confirmation". The customer will receive this within two weeks of Interior Couture GmbH receiving the customer's binding order.
The ordering process is as follows:
Select the product and quantity.
Confirm the selection of the product and quantity by clicking the shopping basket button.
Adding items to the basket will be confirmed, and you will be given the option to continue shopping (banner: "continue shopping") or to proceed with the order (button: "proceed to checkout"). Clicking "continue shopping" allows you to add further products to the basket as described. The selected products can be viewed at any time by clicking the basket icon in the top right-hand corner of the menu, which displays "Shopping basket" when hovered over. Clicking the "Shopping basket" button also gives you the option to continue with the ordering process.
The ordering process takes place in the 3 steps described below:
Step 1 "Shopping basket"
In this step, the items selected by the customer are displayed. Items can be removed from the basket by clicking the "X" symbol. Quantities can also be adjusted up or down within the basket. The purchase price is recalculated automatically. If available, a voucher code can also be entered in the basket. The ordering process is then continued by clicking the "Proceed to checkout" or "Go directly to PayPal" button.
By clicking "View basket", you can display the items in a larger view and edit them there as well.
Step 2: "Delivery information"
In this step, you enter your customer details, register as a new customer, or log in to an existing account. By ticking the box "Delivery address differs from billing address", you can enter an alternative delivery address. Delivery to a parcel locker is not supported. After entering your details and confirming that you have taken note of the privacy policy and GTC, the ordering process continues by clicking the "Continue" button.
Step 3 "Complete order"
In step 3, the entered address is displayed once more, and the delivery address can still be changed if it differs from the billing address. Under "Payment method", select your preferred payment option. You may choose from credit card, instant bank transfer, SEPA direct debit, PayPal and prepayment. The payment method is selected by clicking the small round button next to the label of the respective payment option. The contents of the basket are also displayed and can be edited for the last time. If prepayment is selected as the payment method, the 3% discount will be automatically deducted from the order total and displayed accordingly. You also have the option here to leave notes or questions for our customer advisors in the "Additional information" field, such as preferred fastening types or mattress heights. By confirming "Order with obligation to pay", you complete the order by prepayment or invoice. For all other payment methods, you will be redirected to the respective provider and guided through the payment process.
You may cancel the entire ordering process at any time before placing a binding order by closing your browser.
Once you have completed this step, your order is binding.
You will subsequently receive an order confirmation by email, with which the purchase contract between Interior Couture GmbH and you as the customer is concluded (clause 4.3).
5. Language of Contract
The language of contract is German.
6. Storage of the Contract Text
The contract text of the agreement concluded between Interior Couture GmbH and the customer will be stored by Interior Couture GmbH on its internal systems. The order details, the cancellation policy and the GTC will be sent to the customer by email. Once the order has been completed, the contract text is no longer accessible via the internet for security reasons.
7. Reservation of Delivery
Interior Couture GmbH may withdraw from an already concluded purchase contract if Interior Couture GmbH is exceptionally and permanently unable to deliver the ordered goods for reasons beyond its control, such as non-delivery despite a valid supply agreement concluded between Interior Couture GmbH and the manufacturer/supplier, or force majeure. In such cases, we will notify you without delay of the existing delivery impediment and refund any payments already made.
8. Right of Withdrawal for Consumers
8.1 Consumers are entitled to a statutory right of withdrawal of fourteen days. The cancellation policy can be found below at the end of these GTC. The customer bears the direct costs of returning the goods.
Returns should be sent to the following address:
Düsseldorfer Bettenhaus GmbH
c/o Waesche-Kultur
Bahnstr. 16
D-40212 Düsseldorf
c/o Waesche-Kultur
Bahnstr. 16
D-40212 Düsseldorf
8.2 The right of withdrawal does not apply to consumers who, at the time of conclusion of the contract, are not nationals of a member state of the European Union and whose sole place of residence and delivery address at the time of conclusion of the contract are located outside the European Union.
8.3 The right of withdrawal does not apply, pursuant to § 312d para. 4 BGB, to distance contracts for the supply of goods that are not prefabricated and for the production of which an individual selection or specification by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer. Furthermore, the right of withdrawal does not apply to distance contracts for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery.
9. Prices, Shipping Costs and Payment Terms
9.1 The prices displayed in the shop at the time of ordering apply. All prices stated on the product pages are in euros. The prices shown include the applicable statutory VAT (currently 19% in Germany). VAT will be calculated finally according to the country selected when entering the billing/delivery address prior to payment.
9.2 Shipping costs are not included in the stated prices. These are charged additionally per order. Shipping costs can be viewed on our website under the menu item "Delivery and shipping costs". The exact shipping costs will be displayed before the customer places a binding order (by clicking the "Buy" button at the end of the ordering process).
9.3 For deliveries to countries outside the European Union, additional customs duties, taxes or fees may apply, which are to be paid separately by the customer to the relevant customs or tax authorities, and not to Interior Couture GmbH.
9.4 The purchase price, except in the case of purchase on account, is due upon conclusion of the contract. In the case of purchase on account, the purchase price is due upon receipt of the goods and invoice, and must be paid within 7 days.
Payment can be made by credit card, PayPal, SEPA direct debit authorisation, bank transfer (prepayment) or invoice.
For payments by credit card, PayPal or direct debit, the charge will be made after the purchase contract has been concluded, i.e. after the order confirmation (2nd email) has been sent to the customer, by which Interior Couture GmbH accepts the customer's offer. For prepayment, the payment details will be communicated to the customer in the 2nd email in which Interior Couture GmbH accepts the customer's offer.
For payments by PayPal, direct debit or credit card, the customer data required for payment is entered during the ordering process via a secure internet connection to PayPal or Mollie.
9.5 Within the scope of this contractual relationship, we transmit personal data collected regarding the application, execution and termination of this business relationship, as well as data concerning non-contractual or fraudulent conduct, to GERMANIA INKASSO-DIENST GMBH & CO. KG, Hauptstraße 22, 94469 Deggendorf. The legal basis for this transfer is Article 6(1)(b) and (f) of the General Data Protection Regulation (GDPR). The exchange of data with GERMANIA INKASSO-DIENST GMBH & CO. KG also serves to fulfil statutory obligations to carry out creditworthiness checks (§§ 505a and 506 of the German Civil Code). Further information on the activities of GERMANIA INKASSO-DIENST GMBH & CO. KG can be found in their information sheet or online at https://germania-inkasso.de/datenschutzerklaerung/.
10. Retention of Title
The goods remain the property of Interior Couture GmbH until payment has been made in full. The customer is not permitted to dispose of the goods prior to full payment of the purchase price.
11. Delivery
11.1 The ordered goods will be delivered by post to the delivery address specified by the customer. Delivery times for individual products are indicated in the respective product description.
In particular, goods from the manufacturers Christian Fischbacher, Schlossberg and Graser are made to order.
11.2 Where prepayment has been selected as the payment method, the delivery period begins on the day following receipt of the invoice amount by Interior Couture GmbH. For payments by credit card, direct debit, invoice or PayPal, the delivery period begins on the day following conclusion of the contract.
12. Warranty / Guarantee
12.1 The customer's statutory warranty rights shall be governed by the applicable statutory provisions.
Further information:
Information on statutory warranty rights (PDF)
12.2 For consumers, the statutory limitation period for claims relating to defects in new goods is generally two years. For used goods, the statutory limitation period may, subject to the applicable legal requirements, be reduced to one year.
Where the customer is not a consumer, the limitation period for claims relating to defects in new goods shall be one year. In the case of used goods, warranty claims shall be excluded.
Where the customer is not a consumer, the statutory duties to inspect the goods and give notice of defects pursuant to Section 377 of the German Commercial Code (HGB) shall apply.
12.3 Interior Couture GmbH does not provide any guarantee for the goods sold, unless expressly agreed otherwise. Any guarantee provided by a manufacturer constitutes a separate legal relationship between the customer and the manufacturer. Claims arising from guarantees provided by third parties shall not give rise to any claims against Interior Couture GmbH and must be asserted directly against the respective guarantor.
13. Limitation of Liability
13.1 Interior Couture GmbH is liable in accordance with statutory provisions where the customer asserts claims for damages based on intent or gross negligence, including intent or gross negligence on the part of our representatives or agents. Where Interior Couture GmbH is not accused of intentional breach of contract, liability for damages is limited to foreseeable, typically occurring loss.
13.2 Interior Couture GmbH is not liable for damages caused by simple negligence on the part of Interior Couture GmbH, its representatives or agents, unless these result from a breach of a material contractual obligation. In such cases, however, liability for damages is likewise limited to foreseeable, typically occurring loss.
13.3 Unlimited liability for loss of life, physical injury or damage to health, as well as mandatory liability under the Product Liability Act, remain unaffected by the above limitations of liability.
14. Dispute Resolution
Interior Couture GmbH is neither obliged nor willing to participate in dispute resolution proceedings before a consumer dispute resolution body.
15. Data Protection
Information on the nature and scope of the data collected and your rights can be found under the separate menu item "Privacy Policy" on this website.
16. Governing Law / Place of Performance / Jurisdiction
16.1 The law of the Federal Republic of Germany applies to all legal relationships between the parties, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
In the case of consumers, this choice of law applies only to the extent that it is not superseded by mandatory provisions of the law of the country in which the consumer has their habitual residence.
This choice of law also does not apply with regard to the statutory right of withdrawal for consumers who, at the time of conclusion of the contract, are not nationals of a member state of the European Union and whose sole place of residence and delivery address at the time of conclusion of the contract are located outside the European Union.
16.2 Where the customer is a merchant, the place of performance is the registered office of Interior Couture GmbH.
16.3 Where the customer is a merchant, a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in the Federal Republic of Germany, or moves their place of residence abroad after conclusion of the contract, or their place of residence is not known at the time legal proceedings are initiated, the place of jurisdiction shall be the registered office of Interior Couture GmbH.
Unless otherwise agreed between the parties, the right of withdrawal does not apply to the following contracts:
Contracts for the supply of goods that are not prefabricated and for the production of which an individual selection or specification by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.
Contracts for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery.
